Terms and Conditions – ClearPath Facility Services
By engaging ClearPath Facility Services (“ClearPath”), the client agrees to the following terms and conditions.
Scope of Work
All services are performed based on the agreed scope outlined in estimates, proposals, or service agreements. Any work requested outside of the defined scope may result in additional charges.
Scheduling
Services are scheduled on a first come, first served basis. Clients are encouraged to reserve specific dates and times in advance. ClearPath reserves the right to adjust scheduling due to weather, site readiness, or operational constraints.
Cancellations
Cancellations within 24 hours of a scheduled service may result in a cancellation fee. Repeated cancellations or scheduling disruptions may result in termination or refusal of future services.
Payment Terms
Standard payment terms are Net 30 unless otherwise specified. ClearPath reserves the right to require deposits for larger or high-overhead projects. Late payments may result in service suspension and/or additional fees.
Site Conditions & Access
Clients are responsible for ensuring the site is accessible and ready for service. Delays or inability to perform work due to site conditions may result in additional charges or rescheduling.
Safety
Safety is a priority. ClearPath technicians are authorized to assess working conditions on site. If unsafe conditions are identified, work may be paused or stopped, documented, and rescheduled at ClearPath’s discretion.
Weather & External Factors
Certain services, particularly snow and exterior work, are subject to weather conditions. ClearPath is not responsible for delays or performance impacts caused by weather or other factors beyond its control.
Service Verification
ClearPath utilizes field service systems to document work performed, including time, location, and completion status. This documentation serves as verification of service delivery.
Snow & Ice Management Liability
Snow and ice conditions are inherently variable and may develop rapidly due to changing weather conditions, temperature fluctuations, refreeze, drifting, or other environmental factors.
Unless explicitly stated in a written agreement, ClearPath is not responsible for continuous monitoring of site conditions or for being onsite 24/7. Responsibility for monitoring conditions between service visits remains with the property owner or manager.
If services are limited, delayed, or performed only upon request, the client acknowledges that such limitations increase the risk of hazardous conditions and accepts responsibility for those risks.
ClearPath shall not be held liable for slip-and-fall incidents or other damages occurring before service has commenced, after service completion, or during periods where additional service was recommended but not authorized.
Clients agree that proper risk management requires timely authorization of services, adequate scope design, and reasonable service expectations. ClearPath is not responsible for outcomes resulting from inadequate scopes, restricted service approvals, or client-directed limitations.
Liability Limitations
ClearPath is not liable for damages, delays, or incomplete service resulting from conditions outside its control, including but not limited to weather, access limitations, or client-directed service restrictions.
Termination of Service
ClearPath reserves the right to terminate service at its discretion due to non-payment, unsafe conditions, repeated scheduling issues, or other material breaches of these terms.
